Specific terms — Campaigns module

These terms supplement the general terms of service of responde.app and apply exclusively to the use of the Campaigns module (public landings, sign-up forms, payments and QR ticket issuance). When you create your first campaign you accept these terms.

1. Your role as organizer

When you create a campaign you act as the organizer of the event or initiative. You — not responde.app — are the entity responsible toward sign-ups and third parties (authorities, consumer associations, tax office).

responde.app acts exclusively as a hosting service provider under the terms of article 16 of Spanish Law 34/2002 (LSSI), the EU equivalent of "safe harbor". We provide the technical infrastructure for your campaign to exist on the internet and receive sign-ups, but we do not participate in the relationship between you and your sign-ups.

2. Content responsibility

You are solely responsible for all content you publish on your landing (text, images, event data, external payment methods you mention, etc.). You declare specifically that:

  • The event or initiative you organize exists and will take place as described.
  • You hold rights to the images and texts you publish.
  • If you collect money, it is for your own organization (not for third parties without their explicit written consent).
  • You comply with regulation applicable to your activity (licences, capacity, health, data protection, taxation).

3. Payments and taxation

When you set up a campaign in "Stripe payment" mode, the money lands directly into your Stripe Connect account and from there into your bank account. responde.app never holds that money. The only exception is the fee Stripe transfers to us automatically from each charge.

responde.app fee: €0.50 per ticket (configurable on request). If a buyer purchases 3 tickets in a single transaction, the total fee is €0.50 × 3 = €1.50. Per ticket sold, not per payment transaction.

In addition, Stripe charges its own processing fees (typically 1.5% + €0.25 per transaction for EEA cards). By default the organizer pays these fees (deducted from the amount you receive). You can enable "Pass processing fees to the buyer" in the event settings to add both Stripe fees + ours on top of the price the buyer pays, instead of taking them out of your net amount.

Refunds: if the organizer (or responde.app on behalf of the organizer) issues a refund of an already-paid sign-up, the buyer recovers 100% of what was paid. The cost of the refund is borne by the organizer (~€0.89 extra per sign-up, corresponding to the original Stripe fees that Stripe does not return). The €0.50/ticket responde.app fee is NOT refunded to the organizer, as the service (processing the charge, issuing tickets, sending emails, syncing data) was already provided. Discretionary fee waivers for goodwill can be discussed with support on a case-by-case basis.

This means you are the taxable party for VAT and income tax. You are the one who must issue invoices to sign-ups if requested, and declare this income in your tax filings. responde.app does not issue invoices to your sign-ups on your behalf.

To use Stripe payment mode you need declared business activity. Stripe verifies this in its onboarding flow.

4. Free mode and external payments

If you set up a free campaign and mention an external payment method in the description (Bizum to a phone number, bank transfer, personal PayPal, cash…), responde.app does not intervene in that payment and cannot verify that the sign-up has paid. You handle the payment and mark entry as valid in the guest list or check-in.

5. Prohibited content

It is prohibited to publish campaigns that:

  • Are fraudulent or impersonate third parties.
  • Promote unlicensed gambling, drugs, weapons, or any activity illegal in Spain.
  • Sell alcohol or regulated substances to minors.
  • Collect funds for persons or entities other than the organizer, without written consent from those parties.
  • Contain explicit sexual, discriminatory, violent or hate-inciting content.
  • Infringe third-party intellectual or industrial property rights.

6. Campaign takedown

responde.app reserves the right to provisionally remove any campaign that receives a reasonable complaint via abuse@responde.app. We will notify you by email and you will have 7 calendar days to defend your campaign. After that window without a reply, the takedown is final.

7. Data retention

In compliance with article 12 of LSSI, we retain the minimum data needed to identify the organizer of each campaign (creator email, creation IP, timestamp) for 12 months after event completion or campaign deletion, whichever happens first.

8. Sign-ups and GDPR

Personal data of your sign-ups (name, email, phone) is collected by you, not by us. responde.app acts as a data processor — we store it on your behalf. You are the data controller and must comply with GDPR toward your sign-ups: clear info about purpose, right to opt out, retention limited to the event, etc.

9. Changes to these terms

We may update these terms when needed. Substantial changes will be communicated by email to active organizers at least 15 days in advance.
